Childbirth Support and Parental Leave Pay: Korean Tax Guide for Foreigners
Year-End Settlement
Who this guide is for
- Foreign employees receiving Korean childbirth or parental-leave payments
- Parents checking employer payroll and benefit award records
- HR staff preparing foreign employees' year-end settlement
Quick Answer
Identify each payment's payer and legal basis first. Qualifying Employment Insurance parental-leave benefits are tax-exempt under Income Tax Act Article 12. Employer-paid salary or top-ups need separate classification. Qualifying employer childbirth support can be fully exempt, subject to timing, payment-count and related-party conditions; childcare allowances follow a separate monthly rule. Foreign-worker special tax elections also need review.
Key points
- A family-related payment label alone does not establish an exemption.
- Track statutory benefits, employer salary and childbirth support separately.
- The childbirth-support test and monthly childcare-allowance limit are different rules.
- For 2026, the childcare-allowance ceiling is per eligible child.
- Check the effect of any foreign-worker special tax election before relying on payroll exemptions.
Detailed explanation
Start by separating the payments
A bank deposit described as “parental pay” can represent several different things. Prepare one row for each payment before deciding how to report it.
| Payment | Starting point for review |
|---|---|
| Employment Insurance parental-leave or maternity benefit | Confirm the statutory award and payment period |
| Ordinary company salary or leave top-up | Ask payroll for its wage classification and any specific exemption |
| Employer childbirth-support payment | Check birth date, installment history and related-party conditions |
| Employer childcare allowance | Check the applicable monthly ceiling and eligible children |
| Another family or local-government benefit | Identify its own scheme and rules separately |
The NTS wage-income guide distinguishes statutory parental-leave benefits from employer family-related payments. A familiar label on a payslip is not enough to choose the correct category.
Are statutory parental-leave benefits taxable?
Income Tax Act Article 12(3)(ma) lists qualifying parental-leave benefits, reduced-hours childcare benefits and maternity benefits received under the Employment Insurance Act as exempt. It also contains provisions for specified public-sector and school arrangements; those should be checked under their own legal basis.
Keep the award notice beside the payment history. Do not assume a company-funded payment is the same statutory benefit simply because both arrive during leave.
Tax classification does not itself establish entitlement to a benefit. Foreign employees should confirm insurance coverage, award conditions and documentation with the administering office.
When can employer childbirth support be exempt?
The NTS explanation describes full exemption for qualifying employer payments connected to the employee’s or spouse’s childbirth, subject to statutory conditions.
Under Decree Article 17-2, the count concerns the first and second qualifying payments within two years after birth, and is calculated per employer. The decree also defines excluded related-party relationships: the test differs for an individual employer and a corporate employer.
Make a dated record of each installment. Do not select whichever two payments are largest or assume a third installment has the same treatment. Ask payroll to explain the treatment of any amount outside the qualifying rule.
For example, if your employer pays support in January and July and considers another installment in December, list all three before asking about exemption. The calendar alone does not establish eligibility; the payment purpose, birth date and other conditions still matter.
What is the 2026 childcare-allowance rule?
This monthly allowance is a separate category from childbirth support. The government’s 2026 changes notice states that, for payments from January 1, 2026, the ceiling changed from KRW 200,000 per worker per month to KRW 200,000 per eligible child per month.
Article 12(3)(meo)(2) uses the child’s age at the beginning of the tax year for the qualifying age test. Ask payroll to check the statutory age definition against the child’s exact date of birth rather than relying on an informal age description.
Illustration: if two children both qualify, the combined monthly ceiling is KRW 400,000. If the qualifying allowance actually paid is KRW 300,000, the ceiling does not create another KRW 100,000 of cash entitlement. Do not apply this 2026 ceiling retrospectively to older payments without reviewing that year’s rules.
Does a foreign-worker flat-tax election change the answer?
The NTS foreign-worker guidance issued in January 2026 explains that the special foreign-worker flat-tax treatment excludes ordinary income-tax exemptions, deductions and relief within its scope. Ask payroll to review employer childbirth support and childcare allowances in that comparison.
Do not assume that a special election for employment income changes the classification of every statutory benefit you receive. Identify which payments are employment compensation and obtain a separate explanation for any benefit award. See the foreign-worker flat-tax guide.
Can employer payments affect my leave benefit?
Tax exemption and benefit calculation are different questions. Employment Insurance Act Enforcement Decree Article 98 provides for adjustment where employer payments made because of parental leave, together with the statutory leave benefit, exceed the relevant ordinary-wage amount, subject to its detailed rules.
Keep company top-ups visible when dealing with the benefit office. An employer’s “non-taxable” payroll label is not permission to omit the payment from information requested for a benefit claim.
Build a record that payroll can reconcile
Use a worksheet with these columns:
- Payer and payment description.
- Amount, payment date and covered period.
- Award notice or employer approval reference.
- Proposed taxable or exempt classification.
- Supporting rule and any unresolved question.
Match the worksheet to deposits and payslips without counting a notice and its corresponding deposit as two payments. Keep later corrections linked to the original entry.
Before year-end settlement, ask payroll to explain differences between the worksheet and the withholding receipt. Retain the written response and corrected statement where relevant.
A payment exemption is also distinct from a dependent deduction. Check each claim separately instead of assuming one establishes the other.
Documents you may need
- Birth-date and family-relationship evidence requested by payroll
- Employment Insurance award notice and payment history
- Employer childbirth-support policy and approval record
- Payslips with itemized taxable and exempt amounts
- A dated history of childbirth-support installments by employer
- Year-end withholding receipt and any special-tax election records
Common mistakes
- Treating all money received during leave as tax-exempt
- Applying an older per-worker childcare ceiling to 2026 payments
- Assuming all employer childbirth-support installments qualify
- Ignoring employer ownership or family relationships
- Confusing tax exemption with eligibility for the underlying benefit
- Counting one payment twice because it appears in both a notice and a bank deposit
When should you ask a tax professional?
Ask a qualified tax professional if you have income from several countries, business income, unclear tax residency, treaty questions, missing documents, late filing concerns, or a visa situation that depends on tax records. This site explains general patterns only and cannot review your personal facts.
FAQ
Is company pay during parental leave automatically tax-free?
No. Identify whether it is salary, a top-up, qualifying childbirth support or another payment. Leave status alone does not determine its tax treatment.
Are Employment Insurance parental-leave benefits taxable?
Qualifying benefits paid under the Employment Insurance Act are listed as exempt in Income Tax Act Article 12. Confirm that the award is actually under that scheme.
How many employer childbirth-support payments can qualify?
The rule covers the first and second qualifying payments within two years after birth, with the count determined per employer under Decree Article 17-2. Other conditions, including related-party exclusions, still apply.
What changed for childcare allowances in 2026?
For payments from January 1, 2026, the monthly exemption ceiling became KRW 200,000 per eligible child. This is a ceiling on qualifying employer-paid amounts, not a government payment entitlement.
Does foreign nationality decide eligibility?
Nationality alone does not identify the payment or settle the tax result. Confirm the award's legal basis, payroll conditions and any special tax election. Benefit entitlement is a separate check.
Can I ignore employer top-ups when claiming leave benefits?
No. Employer payments can affect the statutory benefit calculation even if their tax treatment is being reviewed separately. Report the payments and ask the administering office how they affect your award.
